Present: Annette Garthwaite, Woody Garthwaite, Julie Foster, Marlene Greer, Sue Miller, Holly White

Proxy: Karl Brandspiegel, Nita Coleman

Discussion of Trademark Infringement Cease & Desist Letter

Claims

1. Similar name and similar environmental focus create a strong likelihood of confusion among consumers.

2. Multiple individuals from our area have engaged on her social media accounts demonstrating confusion.

3. Concerned about traffic intended for them that inadvertently ends up with us, which stokes a concern they may lose business.

Demands

1. Immediately cease and desist using the name Green Saves Green and any confusingly similar variation.

2. Remove or change the name of all websites, social media accounts, promotional materials and public listing.

3. Confirm in writing we will comply with all demands in 30 days.

Options

1. Keep everything as is with a friendly letter advising of our reasoning and asking for her understanding.

2. Keep our corporate name, 501c3 status, etc. and move forward under a DBA (doing business as), such as Green Saves Green NC. Might need to re-file as DBA. This action does not alleviate her concern over social media conflict.

3. Drop the name and go through a rebranding.

4. Make no further reply.

A motion was made to keep everything as is and send a reply explaining our reasoning and asking for understanding. The motion was approved unanimously. 

Next board meeting will be called as needed.
